Agreement
In consideration of any charter reservation, Charleston Sailing Charters LLC agrees to reserve the vessel FATE, Mystique or Kismet and to contract captain and crew.
Fees and Rescheduling
Charter fees are deemed earned upon placing a hold for desired date and time. Charterer’s requests for rescheduling will be considered on a case by case basis.
Requests to reschedule within 7 days $200, requests to reschedule within 24 hours or less from the start time of the sail are not accepted and Charterer is responsible for full payment, regardless of whether the scheduled sail occurs or not.
Trip Protection (Optional At Checkout)
Purchasing trip protection allows you to cancel or reschedule your cruise at any time for any reason up to 1 hour prior to trip departure. You will be reimbursed for the full amount of charter fee less the cost of trip protection, booking and processing fees. Please contact us by phone for cancellation 843-557-7403
Cancellation by Captain
In the event of a cancellation by the Captain of the vessel due to severe weather, environmental conditions, unforeseen prohibitive events, or mechanical failure, the sail will be rescheduled to a mutually agreeable date prior to December 31st of the current year at no additional charge. Severe weather is determined solely by the Captain of the vessel. If we cannot reschedule, a full refund will be given. We always show up to the boat regardless of the forecast that day, the weatherman is only correct 1% of the time. Just because it rains earlier in the day does not mean we will cancel your sail that afternoon or evening. If the captain determines the weather is unfit for a sail before you arrive they may call you to reschedule or refund.
Cancellation By Guest
In the event of cancellation by the charter guest once paid in full, if you cancel outside 7 days you will receive a full refund, within 7 days you will receive a 50% refund, no refund will be given if you cancel within 24 hours of departure.
Cancelations within 7 days of departure due to health reasons or national emergencies like Covid-19 will be given a gift card via email for the full chartered amount redeemable for a future charter time.
Substance Abuse
The use of illegal substances is strictly forbidden on board the vessel. This includes underage use of alcohol or cigarettes. Non-compliance of this rule will result in the termination of the sail and no refund will be given.
Risks
Charterer understands and accepts that there is an inherent risk of personal injury or accident,”Risks”, which may occur at marinas and aboard sailboats. Therefore, Charterer agrees to release and hold harmless Charleston Sailing Charters LLC, its members, crew and agents from all liability and responsibility for personal injury, property damage or wrongful death however caused, including, but not limited to, product defect or the negligence of the released parties.
Charterer has discussed the Risks with their invitees, and all invitees have agreed to release and hold harmless Charleston Sailing Charters LLC, its members, crew and agents in the same manner Charterer has in the above paragraphs. The foregoing notwithstanding, Charterer agrees to indemnify and hold harmless Charleston Sailing Charters LLC, its owners, crew, and agents from any claims brought by Charterer’s invitees.
If it is necessary to obtain medical treatment for the Charterer or its invitees, regardless of cause, such expenses shall be paid by the Charterer. Authority is granted without limitation to Charleston Sailing Charters LLC
Disputes shall be governed by Federal Maritime law. In any action against Charleston Sailing Charters LLC, Ashley Medaloni Adventures, or its members, agents, partners, employees, or servants which results in a decision/judgment/decree/order/ stipulation or settlement substantially upholding Charleston Sailing Charters LLC / Ashley Medaloni Adventures position, the adversary party shall reimburse Charleston Sailing Charters LLC attorney’s fees, court costs and expenses.
Photography Release
From time to time photos of our guests are captured by our crew and given to the guests or posted on Facebook. I hereby grant Charleston Sailing Charters and Dustin K Ryan and his or her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, for editorial trade, advertising, and any other purpose and in any manner and medium; and to alter the same without restriction. I hereby release photographer and his or her legal representatives and assigns from all claims and liability relating to said photographs.
Agreement
I have read and agree to above and sign this of my own free will and desire. It is my intention that paying for and showing up to the charter is legally binding signature.
We will let you know if your charter will be canceled.
